I'm not sure about the legality of all of this:

So last night I looked at this real gem of a place. The moment I walked in I told the agent "I want it." and I went back to their office checkbook in hand. One other couple had looked at the same place not 10 minutes before me -- they make metric asstons of money, but didn't leave a deposit and were waffling on the move-in date. After they finished talking and left, I broke out the checkbook, wrote the deposit check, wrote the first month's rent check, wrote the broker fee check and they drew up a lease.

Now, when looking at the apartment, the agent and I had to pull some teeth with the landlord to allow me to bring in two cats... but he agreed with me there in the room -- in Polish.

Today, I called the Agency asking what's going on. I was also faxing over my proof of employment, as we agreed upon. They proceed to tell me that the landlord wants the information on the couple who looked at the place before me, DESPITE the fact that I already put down the deposit.

He hasn't signed the lease yet but there's no reason why I shouldn't get the place, right? The deposit's in their hand. I put it down first. He has some obligation to go with the agency, otherwise their word is crap, right?

If this falls through for some reason the agency will either a) find me a new place for free (no broker fee) or b) will never work with me again especially after c) I call the BBB.

Ugh.

I am also having rental nightmares. My landlord is selling the house I live in in San Francisco. He thought it would sell very quickly, but apparently he has not heard about the IMPENDING FINANCIAL COLLAPSE OF THE ENTIRE WORLD. They had several open houses while we were away in Texas, but now they want to continue having them, twice a week in the afternoon, until the house sells.

Not only are they essentially threatening to evict Katie and I, they are taking away my place of business during 2 of my busiest days.

As if moving wasn't stressful enough, having a move forced upon you AND having to live through the bullshit of someone else selling their house when all you want is to KEEP LIVING THERE is totally not awesome in any way.

So my point is, I feel ya man! I FEEL YA.

Yikes. Have you considered buying the house yourself? With all of the IMPENDING RAIN OF FINANCIAL BRIMSTONE (OF DOOM) you might be able to get a good deal on the place, especially if he's having a hard time selling the place. It sounds as if you like the place enough.

Regarding my situation, the agent said she'd call me either 1pm or 3pm. 1pm has already passed. Hmph.

For the price of this house in SF where I am cold all the time and pissed off and mopey, I can buy 2 or 3 houses in Austin.

Probably likely you'll have to find another place. If anything, they'd just come up with some inane reason to turn your application down.

My landlord is battening the hatches for the IMPENDING DOOM, as well. He's a DIY businessman sort, with a hand in a lot of things. He's probably going to be selling part of his business, and some of his rentals. The only thing that will save my house is that it's right next to his. So unless he has to sell EVERYTHING, we're in it together. Fuck, I'd pay another couple hundred bucks just to stay there.

I had a landlord start eviction proceedings once. We had lived there five years and we always put the check in the landlord's mailbox (he didn't live on the property, but if you had non-important business or rent checks, they went in the mailbox.) So we pay our rent...but he doesn't cash it or check the mailbox, then starts eviction proceedings.

Basically, he wanted us out so he could raise the rent substantially. We hafta hire a lawyer, and the day that we're in court he settles with us to leave, and then says "you're welcome to come back and re-rent at the new price! I'd love to have you."

Asshole.

Actually, while it's always a good idea to have a lawyer when doing anything that involves a contract, you may be able to get assistance from your city or county's "Fair Housing Project" or similar agency, regardless of means. (My brother is an attorney for a NY State agency and helps people out in landlord/tenant disputes all the time.) You may want to call your City or County and see if they have a department to help you.

@Reamworks, well right now I'm okay. The lease is pretty clear and is under the Rent Stabilization Act Law Thingamajig. I'm digging being rent stabilized.

...'specially living in the heart of W'Burg. ;)
