I just learned that my landlord is selling the house I live in ASAP. There is an open house on THIS SUNDAY. There is a good chance Katie and I will have to move, and this means moving back to Texas about 8 months before we planned. UGH!

There is a chance that the new owner will re-rent the house to us. Who knows if they will want to raise the rent or something - it is already pretty high.

If they want to move in, apparently the law is that they have to pay each of us (Katie and I, that is...) a few thousand dollars to cover the expense of being evicted.

This of course will not fully cover the cost of moving all of our stuff back to Texas, and then probably into storage, until we can find a new place to move into. Or the inconvenience of totally fucking up our wedding plans. And Katie's job.

Ban - a friend of mine went through the same thing. She refused to move out and eventually got a very large settlement to move. I think you can hold out for more money. Email me if you want her contact info.

I found a 6-month lease 2 houses away from a place in a situation like that on short notice. I'm not saying it's the best decision you can make, but it can happen, and it's cheap!

Also, yeah... you can't really be evicted without a lot of work and money on the part of your new and prospective landlords. And shouldn't the whole house market thing impact this as well? Maybe it won't sell so quickly, or close very quickly... I'll hope for the best for you guys.

Don't worry! It'll take him a YEAR to sell the house, if he's lucky. (Though if he's having trouble paying the mortgage, the bank may end up being the landlord)

Perhaps you can ask the new people to let you stay the remaining time you had planned. This also gives them time to find tenants and the like.

they can only raise rent upon renewal 7%. also, it looks like they can only kick you out before the lease is up if they want to give the space to an immediate family member.

if they try and boot you out, i think it might be cause for you to lawyer up. also, you get something like 180 days notice for an eviction. 6 months is a while. if you've only got 8 months before you want to go back to texas, you might be able to negotiate with the new owner.

although the laws aren't exactly the same, where i am, the house in which i rent my apartment was sold over the summer. the new landlord was legally obligated to honor my remaining lease. as far as i know, when a property is sold, all leases remain in effect until their lawful termination date, unless the property is to be occupied by the new owner or immediate family.

This, btw, is why I moved last month. I moved into the basement of a house on the agreement that it would be mine for at least a year or more, probably more like two years. I agree to build out the space pretty much from scratch since the rent is tiny and the space, while awful in many ways, is quite large. Sadly, I didn't get this in writing. So I have cases of stuff shipped to that address, move in, get up and running, and start doing things like stripping paint off the doors and cleaning out the storage rooms. Less than two months after I move in the owner says that she is about to put the house on the market. So I basically camped out there from June until January while I did all of my other work, finally found a place and here I am.

The bright sides: It gave me an excuse to do even more traveling and staying with friends. Now I've got a better space in a much better location.

I guess that with the freakish real estate market, this kind of crap is really going around.
