UPDATE: the woman had the nerve to respond everywhere, the ripoffreport, my blog--TWICE-- posing as a "satisfied customer". she even took the quiz, because if you check the results, someone has clicked the terrible person answer. what i'd really like to do is post some horrifying gif or captcha indicating that she's been "traced" (omfglol) i did IP trace and surprise surprise, it's bellsouth, and i was all set to post links to those two captchas when i thought it would be HILAR to scare the shit out of her with a fake message.

anyone got a fab scary blue screen or some trace message? something really fucking creepy scary? satellite footage of her house with the ip address and techie blurbage maybe?

Attorneys aren't necessary (and sometimes not allowed) for small claims court. You have all the documentation you need. A judge will hear evidence from both sides and ask questions of the both of you.

In my book, it's a pretty clear case. She can't bill you for any of those charges, because she never had any contract with you (verbal or written) for any of those. They will be thrown out. As for your claim, the judge *could* decide that by prepaying with a discount, you forfeited your right to claim a refund if the entire year's board was not used. However, and this is the BIGGIE, this would have had to been made clear to you by her upfront. If the stable policy is to provide refunds for services not used (which would be the case unless she declares so otherwise), then any contract she would have had to make with you about prepaid would have to include the exclusion of a refund. I don't believe she did this (at least not according to any evidence you have presented), so you should be entitled to a refund.

Also, I would include the charges she made on your credit card, if they were not authorized. Be prepared to prove that the charges she made were in excess of what would be reasonable for gas expenses.
